What man or group of men is above being held accountable for their actions?  Before Bill Number SB 82 was introduced to the Kentucky Senate on January 7th 2010, not all boards and commissions in the state were subject to the existing Executive Ethics Code that had been set forth by Kentucky statutory law, only employees of the boards and commissions were held liable for what was considered by the Executive Ethics commission to be "unethical" behavior. Under Bill SB 82, all members of any board or commission shall be held accountable for any behaviors deemed unethical by the Executive Ethics Commission. This will include the Kentucky Board of Chiropractic Examiners who, under this new provision, will no longer be left to their own devising; under this bill they will be subject to the ethical rules set forth in the code where previously they were exempt.

The Kentucky Board of Chiropractic Examiners (K.B.C.E.) is responsible for regulating the practice and licensure of chiropractic in the Commonwealth of Kentucky. The Board grants initial licensure to qualified chiropractors and also oversees the annual renewal of licenses. Their duties also include increasing general awareness of regulations concerning professional and business practice standards, continuing education, and licensure requirements. The Board also investigates any complaints against practioners and is responsible for imposing disciplinary sanctions against those who violate Kentucky Revised Statutes Chapter 312 and Kentucky Administrative Regulations, Title 201, Chapter 21. Considering the duties and responsibilities of this body it is only logical that they be made to answer to a higher committee.

On March 7th, 2010, Bill SB 82 was approved by the Kentucky State Senate and sent to the Kentucky State House of Representatives for further deliberation. We at the K.C.A. (Kentucky Chiropractic Association) would like to stand in full support of the Senate's decision to approve this bill and urge the House to follow their judicious lead. Currently the K.B.C.E., a regulating body, is operating outside of the parameters of accountability; a history of complaints regarding the K.B.C.E. to the Executive Ethics Commission have fallen to the wayside as no higher body maintains province over the K.B.C.E. 

The K.B.C.E. is an organization developed to ensure and maintain the quality and conduct of any person who seeks to provide chiropractic care within the commonwealth. An organization with such profound responsibilities can no longer continue to escape ethical accountability. The Kentucky State Senate, in approving Bill SB 82, has shown excellent judgment; the K.C.A. has every confidence that the Commonwealth's House of Representatives will follow their lead and place a body of great power, yet questionable ethics, under the scrutiny of a higher, ruling body.
